This site recently reported on the case of Harold St. John, whose family was prevented from burying their loved one because of a legal request for an autopsy. The family is engaged in a lawsuit against several auto parts manufacturers, claiming St. John was exposed to asbestos while working with the products as an auto mechanic. St. John recently died of mesothelioma, a cancer that is caused by asbestos.
Attorneys representing the defendants in a mesothelioma death case prevented a New Jersey family from burying husband and father Harold St. John, according to a story in the New Jersey Star-Ledger. On the day of the scheduled burial, a judge ordered the funeral home to hold the body and return it to the coroner’s office until a decision is made whether or not an autopsy will be allowed. The matter is now in Superior Court in New Brunswick, N.J.
A man diagnosed with mesothelioma earlier this year will receive a $7.5 million settlement against 11 defendants that reportedly made, supplied or distributed the asbestos-containing products he handled and was exposed to in the workplace, according to a story in the Times-Herald. Robert Hilt of Vallejo, Calif., is 64. It is believed he developed mesothelioma during his work as a marine machinist.
A report published by the Insurance Journal on May 28 says a group of Spanish workers injured by asbestos-containing insulation while working on Navy ships docked in Spain can sue the manufacturer of the insulation in New Jersey — where the products were produced.
A San Francisco jury awarded a $20 million verdict to Joan Mahoney, a 69-year-old woman with mesothelioma, and her husband, Daniel. The case was presided over by Judge Thomas Mellon in San Francisco County Superior Court. The judgement finds Georgia Pacific liable for the production of asbestos-containing joint compound used in construction. Mrs. Mahoney handled the material in her part-time work with the family construction business.
A six-member jury in Superior Court in Bergen County, New Jersey, ruled on Feb. 26 to award the family of Mark Buttitta a settlement of $30.3 million. The judgment is one of the largest ever in asbestos litigation in the state. Buttitta died of mesothelioma just before Christmas 2002, at age 50, after being diagnosed in 2001. Mesothelioma is lung cancer attributed to asbestos exposure. Mark Buttitta is survived by his wife and three daughters.
A Superior Court in Los Angeles awarded former Navy sailor John R. “Jack” Davis $35.1 million in compensatory damages for his diagnosis of pleural mesothelioma, an aggressive cancer linked to asbestos. Davis was diagnosed in January 2007.
