Wisconsin widow can sue for asbestos-related death

A Wisconsin appeals court has ruled that a woman who lost her husband to mesothelioma in 2004 is within her rights to sue his former employer. The man, Walter Tatera, worked in a machine shop, where he ground brake linings to be installed in automobiles. His widow claims the manufacturer failed to warn her husband that the parts contained asbestos and could pose a health hazard.

When inhaled, fibers can become lodged in the body and cause serious health problems, such as asbestosis, a severe scarring of the lungs, and , a deadly that affects the lining of the lungs and, sometimes, the stomach and/or heart.

The mesothelioma lawsuit was filed by Vicki Tatera of Greenfield, and was reinstated on Tuesday by the District 1 Court of Appeals. The defendant is FMC Corp. The case will now go to trial.

Sifting sand for asbestos

An Illinois power company recently obtained permission from the Illinois to try to remove chunks of asbestos and particles from sand dredged from a canal that draws water from Lake Michigan. This is the latest in a series of concerns about that wash up onto Illinois shores, including Illinois Beach State Park, dubbed Beach by environmental watchdog groups.

Asbestos Beach open for summer

About a month ago, this site shared information about the latest investigation of Chicago’s Oak Street Beach, which has been examined several times by the () because of asbestos contamination. In June, the Environmental News Service, an independently owned and operated daily international wire service for environmental news, reported the beach has been inundated with fibers from the Johns-Manville Superfund site for the past 20 years.
