The Occupational Health and Safety Administration (OSHA) has cited Massachusetts-based contractor William A. Berry & Son Inc. for 18 alleged violations of workplace health and safety standards related to asbestos removal. The citation comes in conjunction with an asbestos-removal project at Beth Israel Hospital in Boston, which occurred last September, according to a report in the OH&S magazine.
People suffering as a result of asbestos exposure, including mesothelioma victims and their loved ones, have asked the Indiana legislature to consider making an exception to state law that would allow victims to file cases against companies they feel are responsible for their illnesses.
A recent report on Forbes.com said clinical trials are validating the success of the drug Alimta in treating patients with non-small cell lung cancer, providing hope for cancer patients and a jump in stock prices for the drug’s manufacturer, Eli Lilly and Co. The drug also has been approved as a treatment for mesothelioma.
According to a report in “The Pulse,” a publication covering Chattanooga, Tenn., a Hamilton County jury awarded $1.4 million on Monday to Marion Jackson, who lost her husband to mesothelioma. The defendant in the case was North Brothers, and the paper reports this is believed to be the first successful judgment against that company.
Almost one year after the Tennessee Supreme Court made a precedent-setting decision related to asbestos exposure, the Satterfield family has settled with Alcoa Aluminum. The settlement puts to rest a six-year legal fight by Doug and Donna Satterfield on behalf of their daughter, Amanda, who died of mesothelioma in 2005 as a result of years of exposure to asbestos brought home on her father’s work clothes, from his job at Alcoa .
A story on Justice News Flash.com reports the U.S. Environmental Protection Agency has cited two Vermont companies, a demolition firm and a real estate company, saying they violated federal laws by neglecting to inspect for asbestos prior to beginning work on a job site and failing to properly dispose of debris possibly containing asbestos. The companies, Trust and CRC Evacuating, were charged with violations of the Clean Air Act and the National Emission Standards for Hazardous Air Pollutants.
Members of the New Orleans City Council are locked in debate with Nola Mayor Ray Nagin’s office over a proposal to move City Hall. The plan would include the purchase of Chevron Corp.’s former headquarters building to house the city government offices. At a recent meeting, City Council representatives voiced concern about the expense of purchasing the new building, but the Mayor’s office argues necessary repairs to the existing City Hall facility – including asbestos removal – would far exceed the purchase price for the newer building.
The Israeli news agency Haaretz.com reported recently that the northern coastal city of Nahariaya and its surrounding area has one of the largest concentrations of people diagnosed with mesothelioma, in the world. Until 1997, the city was home to the only asbestos plant in the country. Mesothelioma is directly linked to asbestos exposure.
According to a report in Risk & Insurance magazine, legislation currently pending in the Texas Senate would make it easier for people with mesothelioma lawsuits to have their day in court. Senate Bill 1123, which is sponsored by Senator Robert Duncan (R-Lubbock) would eliminate the need for mesothelioma victims to prove exactly how much asbestos they had been exposed to as the source of their cancer.
A jury in Newport News, Virginia, Circuit Court awarded the family of a former Navy sailor $1.2 million, finding that his death from mesothelioma was linked to the asbestos fibers he inhaled during his career. Gerald Gray died in April at age 75, after battling mesothelioma for 16 months. Mesothelioma is a rare cancer that most often affects the lining of the lungs, but which can also affect the lining of the abdomen or, more rarely, the heart. It is caused by asbestos exposure.
